Terms and Conditions of Use of Amico Fido

1. Introduction and object of the service

Amico Fido is a digital platform offering information tools and a community for dog owners. The service includes, among other things: a map with geolocated reports, veterinary clinics, dog areas and pet stores; artificial intelligence-based features (including Ask Bia, toxicity check, AI dog profile, training video analysis, photomontages and an interactive situation simulator); chat and community; shareable dog profiles; the Memories Diary with link sharing and viewing on the website; Safe Walk; premium subscriptions through Amico Fido Club (including Amico Fido Academy for dog training with artificial intelligence support).

Access to or use of the mobile application, website and related services constitutes acceptance of these Terms and Conditions.

2. Identity of the provider

3. Scope of application and acceptance

These Terms apply to the use of the Amico Fido application (iOS and Android) and the amico-fido.com website.

By accessing or using the service, the user declares that they have read, understood and accepted these Terms and the Privacy Policy. In case of substantial changes, the user may be invited to re-accept the Terms; continued use after the change constitutes acceptance of the new conditions.

4. Requirements for use

The service is intended for persons who:

  • are of the minimum age required by applicable law to independently use the service or validly provide consent where required (generally at least 16 years of age in the European Union; 13 years of age in the United States, with parental or guardian consent for children under 13);
  • have the capacity to enter into valid contracts;
  • provide correct and up-to-date information;
  • have not been excluded or suspended from the service.

Use of the service by minors is permitted only with the consent and under the responsibility of the parent or holder of parental responsibility.

5. Registration, account and credentials

Access requires creating an account via email and password or via social login (Google, Apple). The user must:

  • keep credentials confidential;
  • promptly report any unauthorised access;
  • provide truthful and up-to-date data.

The provider is not responsible for damage resulting from improper use of credentials by the user or third parties.

6. User profiles and dog profiles

The user may create a personal profile and one or more dog profiles. Dog profiles may be made accessible via link or QR code without authentication. The user is responsible for the information entered and for the choice to share dog profiles publicly.

The Memories Diary may be shared via link: the selected content may be viewed on the website by anyone who receives the link, including optional background music. The user is responsible for enabling or disabling sharing and for the materials made accessible.

7. User-uploaded content

The user may publish posts, stories, comments, community questions, geolocated reports, chat messages and other content. By publishing, the user guarantees that they hold the rights to the content or have authorisation and that they do not violate third-party rights or applicable laws.

8. Licence to use content

By publishing content, the user grants the provider a non-exclusive licence necessary for the provision, publication, moderation and operation of the service, as well as for the display, sharing and promotion of the service within the platform, according to the methods provided by the service itself.

The licence is limited to the period during which the content remains published on the service. In case of account closure, the provider proceeds to remove or anonymise content according to technical procedures and legal obligations. The licence does not extend beyond what is strictly necessary to complete such operations and to comply with legal obligations, security requirements or abuse prevention, within the limits permitted by law and the Privacy Policy.

9. Rules of use and prohibited content

It is prohibited to publish content that:

  • is unlawful, defamatory, offensive, threatening or discriminatory;
  • incites hatred, violence or self-harm;
  • constitutes harassment, spam or fraud;
  • violates third-party intellectual property or privacy rights;
  • contains third-party personal data or information that the user has no right to share;
  • is false or misleading, including in geolocated reports.

The provider reserves the right to remove content and to suspend or close accounts in case of violation, including on the basis of user reports and automatic checks.

More detailed conduct rules are set out in the Community Guidelines, accessible in the application under Profile → Legal & Privacy. The Community Guidelines form an integral part of these Terms.

10. Community, interactions, chat and reports

The platform offers individual chat, community chat (themed rooms), Walk Buddy and lost-dog messaging, stories, posts, comments and reporting tools. You may block other users and report inappropriate content. Reports are examined by the provider according to internal procedures; no specific outcome is guaranteed.

Blocking. When you block a user, that person generally cannot send you direct messages, see your profile in discovery or Walk Buddy flows, or interact with you through features that respect the block. Blocking does not automatically remove past content already visible in community areas, delete messages already delivered, or prevent the blocked user from seeing public content you have published (for example posts or stories visible to the community). You may manage blocks from the relevant profile or settings screens.

Geolocated reports (e.g. dangers, poisoned baits) are for preventive and informational purposes. In case of real suspicion, you must contact the competent authorities. The provider does not verify the accuracy of reports and is not liable for damage resulting from their use.

11. Geolocation features, map and Safe Walk

Map data (clinics, dog areas, stores) is provided by third parties (e.g. Google, BDC.io). The provider does not guarantee completeness, accuracy or availability of the indicated services. You must verify opening hours and conditions before visiting.

The "Safe Walk" feature allows recording the route and receiving alerts about nearby reports. When you start a walk, the app may request continuous location access, including in the background, and periodically send location updates (heartbeat) to maintain the session. Where available, you may share your live route with a trust circle or via a public link; anyone you authorise or anyone with the link may see location and/or route according to your settings.

The service does not constitute an emergency or active surveillance service. It does not guarantee interventions, rescue, prevention or absence of dangers. Operation depends on GPS, connectivity, provider availability, battery, device permissions and timeliness of user reports.

The provider does not guarantee: (i) position accuracy; (ii) timeliness of alerts; (iii) completeness of reports; (iv) absence of dangers in unmarked areas; (v) confidentiality of a shared link if you disclose it to others. You use the feature at your own risk and must not rely on it exclusively for your own or your animal's safety.

12. Artificial intelligence-based features

The service includes features based on artificial intelligence (e.g. Ask Bia, toxicity check, AI dog profile, training video analysis, AI photomontages with image generation, interactive situation simulator). These features:

  • are for informational purposes and do not replace the advice of veterinarians, trainers or other professionals;
  • provide "as is" indications, without guarantees of completeness or accuracy;
  • may be incomplete or incorrect.

The user must not rely exclusively on AI responses for decisions regarding the dog's health, safety or behaviour. In case of doubt, they must consult a veterinarian or qualified professional. The provider is not liable for decisions or actions based on AI feature results.

13. Subscriptions, in-app purchases and premium features

Subscriptions and in-app purchases relating to Amico Fido Club, Amico Fido Academy and similar premium features are managed through the stores (App Store, Google Play) and, where applicable, through RevenueCat. The user must comply with the store conditions.

Subscriptions may provide for automatic renewal, unless cancelled by the user via their App Store or Google Play account, according to the rules of the store used.

Cancellation prevents subsequent renewals but, unless otherwise provided by the store or applicable law, does not immediately interrupt access to already purchased premium features, which remain available until the end of the current billing period.

Refunds, revocations, reactivations and purchase restoration are subject, primarily, to the conditions of the store through which the purchase was made, without prejudice to any inalienable rights under the law.

Right of withdrawal. For purchases of subscriptions or digital content made by consumers in the European Union, the applicable consumer law provisions on the right of withdrawal apply. Where the execution of the digital service begins immediately upon the user's express consent and acknowledgment of the consequent loss of the right of withdrawal, such right may be excluded as provided under applicable law. In any event, mandatory rights provided by the law of the consumer's country of residence are not limited by these Terms. For refunds and withdrawal related to purchases made through the App Store or Google Play, the respective store policies apply and constitute the primary applicable framework.

The provider reserves the right to modify, suspend or discontinue premium features, with notice where reasonably possible.

14. Third-party services and content

The service uses third-party services (e.g. Google, OpenAI, RevenueCat for subscriptions linked to the stores, Sentry for error and crash monitoring in the app, payment providers, notification services). The provider does not control such services and is not liable for interruptions, errors or changes by third parties. Service availability and performance also depend on such providers.

15. Moderation, suspension, limitation and account closure

The provider may take proportionate measures, including removal or limitation of content visibility, temporary suspension of the account or closure thereof, when it detects violations of these Terms, legal obligations, third-party rights, risks to platform security or abusive, fraudulent or potentially harmful conduct.

Where reasonably possible, the provider may inform the user of the measures taken and the reasons, except where such communication is not appropriate for security or abuse prevention reasons or legal obligations.

The user may report content and block other users. Reports are examined according to internal procedures; no specific outcome is guaranteed.

16. Intellectual property

The Amico Fido trademark, logo, texts, design and software of the service are owned by the provider or licensed. It is prohibited to use them without written authorisation, as well as to copy, modify, reverse engineer or use the service for unauthorised purposes.

17. Service availability and functional changes

The provider undertakes to provide the service with due diligence, but does not guarantee uninterrupted availability. Interruptions may occur for maintenance, updates or force majeure. The provider may modify service features with notice where reasonably possible.

18. Exclusion and limitation of liability

To the extent permitted by law, the provider is not liable for indirect, consequential, punitive or data or profit loss damages. The provider's total liability, where applicable, is limited to the amount actually paid by the user in the last twelve months for the service.

No provision of these Terms excludes or limits the provider's liability in cases where the law does not permit it, such as, by way of example, wilful misconduct, gross negligence, personal injury, death or product liability.

The provider is not liable for: (i) content published by users; (ii) accuracy of geolocated reports; (iii) AI feature results; (iv) availability or accuracy of third-party data; (v) damage resulting from improper use of the service or violation of the Terms.

19. Indemnity

The user undertakes to indemnify the provider, within the limits permitted by law, from claims, damages and costs arising from content uploaded by the user, from violations of these Terms, from violations of third-party rights or from unlawful use of the service attributable to the user.

20. Duration, termination and account deletion

You may close your account at any time through the functions provided in the app. If you registered with email and password, closure may require password confirmation. If you access via Google or Apple (OAuth), you may need to complete additional verification steps shown in the app; disconnecting the app from your Google or Apple account settings alone does not necessarily delete your Amico Fido account or associated data.

Upon closure, content associated with the account is deleted or anonymised according to technical procedures and legal obligations. Access tokens are revoked and main features cease to be available. Some data may be retained for legal obligations, security, dispute resolution or abuse prevention, and residual copies may persist temporarily in backups according to normal technical cycles.

After deletion, the account cannot be restored. Active subscriptions remain governed by App Store or Google Play conditions until natural expiry; cancelling the Amico Fido account does not automatically cancel store subscriptions.

You may create a new account later, but previous content and history will not be automatically recovered unless expressly provided by the service.

21. Changes to the Terms

The provider may modify these Terms. Substantial changes will be communicated by appropriate means (e.g. in-app notification, email). Continued use after the changes take effect constitutes acceptance. If the user does not accept, they may cease use and close their account.

22. Applicable law and competent court

These Terms are governed by Swiss law, without prejudice to the application of any mandatory more favourable provisions of the law of the country of residence of the user qualifying as a consumer.

For any dispute relating to the interpretation, performance or validity of these Terms, the court of the place of residence or domicile of the consumer shall have jurisdiction, where provided by applicable law. In other cases, the exclusive place of jurisdiction shall be Lugano, Switzerland.

Alternative Dispute Resolution. For consumers residing in the European Union, the European Commission's Online Dispute Resolution (ODR) Platform is available at https://ec.europa.eu/consumers/odr. The provider is not obligated to participate in alternative dispute resolution (ADR) procedures before a consumer conciliation body, unless such obligation is required by applicable law.

Severability. If any provision of these Terms is found to be invalid, void or unenforceable in whole or in part, the remaining provisions shall remain in full force and effect.

Language of the contract. These Terms are provided in multiple languages for the convenience of the user. In the event of any discrepancy between language versions, the Italian version shall prevail.

24. Walk Buddy and in-person meetings

Walk Buddy and related discovery features are designed to help dog owners connect online for possible joint walks. Amico Fido does not organise, supervise or guarantee in-person meetings, does not perform background checks on users and does not verify the identity, conduct or suitability of participants.

If you choose to meet another user in person, you do so at your own risk and responsibility. We recommend meeting in public places, informing a trusted person of your plans, keeping control of your dog at all times and ending the meeting if you feel unsafe. Never share unnecessary personal or financial information.

The provider is not liable for conduct, statements, injuries, property damage, theft, fraud or any other harm occurring before, during or after in-person meetings between users, except where liability cannot be excluded under applicable law.

25. Blocking other users

You may block other users from their profile or from relevant interaction screens. Blocking is intended to limit unwanted contact and visibility within the service.

Depending on the feature, blocking may prevent the blocked user from sending you direct messages, appearing in certain discovery or Walk Buddy lists, or initiating new interactions with you through features that respect the block. Blocking does not guarantee that the user will never see content you have already published in public community areas, nor does it remove messages already delivered or retroactively hide all past interactions.

The provider may retain minimal technical records of blocks for security and abuse prevention. If you believe a blocked user is circumventing the block or engaging in harassment, you should report the conduct through the in-app reporting tools and, where appropriate, contact the authorities.

26. Account deletion and Google or Apple sign-in

Account deletion is initiated from the in-app account settings. The procedure may differ depending on how you authenticate:

  • Email and password: deletion may require confirmation of your current password.
  • Google or Apple sign-in: you may be asked to re-authenticate or confirm deletion through steps shown in the app. Removing Amico Fido from your Google or Apple account permissions, or deleting the app from your device, does not by itself delete your Amico Fido account or the data we hold.

After confirmed deletion, we deactivate the account and begin deleting or anonymising associated content and personal data according to our Privacy Policy, technical processes and legal obligations. OAuth identifiers linked to your account are revoked for future access.

Some information may be retained for limited periods where required by law, for security, to handle disputes or to prevent repeat abuse. Residual copies in backups may be removed according to normal retention cycles.

27. Digital Services Act (DSA) and notice of illegal content

For users in the European Union, Amico Fido complies with applicable obligations under Regulation (EU) 2022/2065 (Digital Services Act) regarding illegal content on the platform, to the extent applicable to the service.

If you wish to report content you believe is illegal under applicable law (for example content involving child sexual abuse material, credible threats of violence, incitement to hatred constituting an offence, or other clearly unlawful material), you may contact us at info@amico-fido.com, providing:

  • a clear description of the content and its location in the service (link, screenshot or sufficient identifiers);
  • the legal reason why you consider the content illegal;
  • your contact details, unless reporting anonymously is permitted and appropriate for the type of content concerned.

We will review reports in good faith and take appropriate measures within reasonable timeframes, which may include removal, restriction of visibility, account measures or referral to competent authorities where required by law. This contact point is without prejudice to other reporting tools available in the app and to your right to contact law enforcement directly in urgent situations.
